TERMS AND CONDITIONS

We are pleased to welcome you to the BOOKINGMAP website available at https://bookingmap.io/. You are accessing the Platform subject to your agreement to all of the following terms, conditions and notices (hereinafter referred to as the "T&C").

1. About this T&C

1.1. By accessing or using the Platform, you agree to this T&C and declare that you have read and understood its terms. If you do not accept these terms and conditions, you may not use our Platform. 

1.2. If any provision of this T&C is (or becomes) invalid or unenforceable:

it will still apply to the maximum extent permitted by law;

you will continue to be subject to all other provisions of the T&C.

1.3. We may amend or otherwise modify this T&C in the future in accordance with the provisions set out herein, and you acknowledge that accessing or using the Platform following such amendment means that you accept the updated or amended terms of this T&C.

2. About BOOKINGMAP

2.1. Booking map LLP - registration number: OC439849, legal address: 390-392 High Road, Ilford, England, IG1 1BF.

2.2. Our Platform is provided for the sole purpose of:

assist users in searching, booking and reserving travel services;

assist travel, tourism and hospitality businesses in attracting customers and potential customers by providing free and/or paid services through BOOKINGMAP.

2.3. When you make a Booking on our Platform, BOOKINGMAP is not responsible for the Travel Product itself. We do not participate in the agreements between you and the Service Provider. The Service Provider is solely responsible for the Travel Product.

2.4. We take reasonable precautions when providing our Platform, but we cannot guarantee that all information on it is accurate (we obtain information from Service Providers). To the extent permitted by law, we are not responsible for any errors, interruptions or missing information, although we do everything we can to correct this as soon as possible.

2.5. Our Platform does not constitute a recommendation or endorsement of any Service Provider or its products, services, facilities, vehicles etc.

3. Rules for the use of the Platform

3.1. By using our Platform, you undertake:

To comply with the provisions of this T&C and other internal BOOKINGMAP policies;

To comply with all applicable laws;

To cooperate with any anti-fraud / anti-money laundering checks that we need to conduct;

Not to use the Platform to disrupt the order or to make false Bookings;

To use the Travel Product and/or the Platform for their intended purpose;

Not to cause inconvenience or damage to the Service Provider’s personnel or behave inappropriately to the Service Provider (or anyone else).

4. User Accounts

4.1. In order to make a Booking, you may need to create an Account. Make sure that all your information (including payment and contact details) is correct and up to date, otherwise you may not be able to access your Travel Product(s). 

4.2. You may only register legal entities and individuals over the age of 18 years. 

4.3. You represent and warrant that you are not a person or entity prohibited from using the BOOKINGMAP Platform under the laws of your domicile or any other applicable jurisdiction. 

4.4. You may not register more than one account or transfer your account to another person. 

4.5. You are responsible for maintaining the confidentiality and security of your account information and may not disclose it to any third party. 

4.6. You must notify BOOKINGMAP immediately if you suspect that your account details have been lost, stolen or otherwise compromised. 

4.7. You are responsible for all activities carried out through your BOOKINGMAP Account.

4.8. Where permitted by applicable law, we may, but are not required to (i) ask you for identification or other information, (ii) conduct checks designed to help verify your identity or your biography, (iii) check you against third party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal or sex offender registrations or their local equivalents.

5. Prices

5.1. By making a Booking you agree to pay the price of the Travel Product including any fees and taxes that may apply.

5.2. Some of the prices you see may have been rounded to the nearest whole number. The price you will pay will be based on the initial, "unrounded" price (although the actual difference will be negligible anyway).

5.3. Obvious errors and typos are not valid. For example: if you book a premium car or night in a luxury suite that has been incorrectly offered for €1, we may cancel that Booking and refund the full amount paid.

6. Payment

6.1. For some products/services the Service Provider requires a Prepayment and/or payment to be made at the time your Travel Product is provided.

If we arrange your payment, we are responsible for managing your payment and carrying out your transaction with our Service Provider. In this case, your payment represents the final set-off of the "payable" price.

If you are charged by your Service Provider, this will usually be in your presence at the start of the Travel Product, but it may (for example) be the case that your credit card is charged when you make the booking or you pay when you check out of the Accommodation. This depends on the Service Provider's Prepayment policy and you will be informed of this during the booking process.

6.2. If the Service Provider requires a Prepayment, it may be deducted or set aside as pre-booked funds when making the Booking and may be non-refundable. Therefore please read the Service Provider's Prepayment policy before you make your booking. We have no influence on or responsibility for these regulations.

6.3. If the currency selected on the Platform does not match the currency of the Service Provider, we may

display prices in your currency;

offer you to pay for your booking in your own currency.

6.4. You will see our Currency Exchange Rate at the time of booking, in the Booking Details section of your Account or (if you do not have an Account) in an email sent by us. 

6.5. We will keep your Payment Method information for future transactions once we have received your consent.

7. Rules applicable to Booking

7.1. By making a Booking you accept the applicable rules displayed during the booking process. You will find each Service Provider's cancellation policy and any other policies (on age requirements, deposits/insurance deposits, surcharges for group Bookings, extra beds, breakfast and pets, and accepted cards, etc.) on our Platform: on the Service Provider information page, in the booking process, in the important information section and/or in the booking confirmation email or ticket (if applicable).

7.2. If you cancel your Booking or no-show, any cancellation/no-show fee and any refund will be subject to the Service Provider's cancellation/no-show policy.

7.3. If you have booked a Travel Product and made a prepayment (including all elements of the price and/or security deposit, if applicable) the Service Provider may cancel the Booking without notice if it is unable to collect the balance on the relevant date. If he does so, any non-refundable payment you make will be refunded only at the discretion of the Service Provider. It is your responsibility to ensure that the payment is made on time (that your bank, debit card or credit card details are correct and that there are sufficient funds in your account).

7.4. If you have any concerns about not arriving on time, contact your Service Provider and let them know when they can expect you so that they will not cancel your Booking. If you are late, we will not be liable for the consequences (for example, cancellation of your Booking or any fees your Service Provider may charge).

7.5. As the person making the Booking, you are responsible for the actions and conduct (in relation to the Travel Product) of all members of your group. You are also responsible for obtaining consent from those individuals before providing us with their personal data.

8. Privacy and cookies

8.1. The personal data you publish or otherwise provide in connection with your use of the Platform will be used in accordance with the Privacy Policy. 

9. Insurance

9.1. If you have purchased insurance through our Platform, read the terms and conditions and additional information in the policy document(s). This T&C does not apply to insurance.

10. Intellectual property rights

10.1. The Materials and information available on the Platform (including but not limited to messages, data, information, text, music, sound, photographs, graphics, video, maps, icons, software, code or other materials) and the infrastructure used to provide such Materials and information are the property of BOOKINGMAP or provided to BOOKINGMAP by third parties under license. 

10.2. You agree not to modify, copy, transmit, display, perform, reproduce, publish, license, transfer the Materials that are not your Materials, create derivative products from them, or sell (or resell) information, software, products or services obtained on or through the Platform. 

10.3. We carefully monitor every visit to our Platform and block anyone we suspect of

sending an unreasonable number of searches;

using any device or software to collect price data or other information;

doing anything that causes an excessive load on our Platform.

10.4. By uploading an image to our Platform (e.g. with a feedback), you confirm that:

it is correct (in particular, you have not modified the image or uploaded an image of another posting object);

it is virus-free;

you are authorised to share it with us;

we are authorised to use it on our platform and for further commercial purposes (including for promotional purposes), anywhere and at any time;

it does not violate the privacy rights of others;

you assume full responsibility for any related legal claims against BOOKINGMAP.

10.5. We are not responsible for any image uploaded to our Platform. We may remove any image at our discretion (for example, if we find that the image does not meet the above criteria).

11. Complaints

11.1. If you have any questions or complaints, please contact our Support Team. You can do this by logging in to your Booking.

11.2. We try to resolve disputes using BOOKINGMAP's internal procedures and are not obliged to submit to any alternative dispute resolution procedures carried out by independent suppliers.

12. Communication with the Service Provider

12.1. We may facilitate your communication with the Service Provider, but we cannot guarantee that the Service Provider will read your messages or do what you ask. The mere fact that you contact the Service Provider or he contacts you does not mean that you have grounds for legal action.

13. Measures to deal with unacceptable behavior

13.1. We have the right to prohibit you from making any Bookings, to cancel any Bookings you have already made and/or to terminate your use of our Platform, our Support Team and/or your Account. Of course, we will only do this if, in our opinion, there is a good reason for doing so, such as:

Fraud or misconduct;

Failure to comply with this T&C or applicable laws or regulations;

Inappropriate or unlawful conduct (such as violence, threats or invasion of privacy) towards us, any of the companies we work with or anyone else.

13.2. If we cancel a Booking as a result, you will not be entitled to a refund. We may tell you why we have cancelled your Booking unless telling you the reason for the cancellation would a) result in a breach of applicable law and/or b) prevent or hinder the detection or prevention of fraud or other illegal activity. If you believe we have mistakenly cancelled your Booking, please contact our Support Team.

14. Caution. International travel. 

14.1. When you book tickets for international travel, it is your responsibility to ensure that all requirements for entry abroad are met and that your travel documents, including passports and visas, are in order. Contact the relevant embassy or consulate for passport and visa requirements. As requirements may change at any time, be sure to check up-to-date information before you make your booking and before you leave.

14.2. BOOKINGMAP are not responsible for travelers who are denied boarding on a flight or entry into any country because the traveler does not carry the travel documents required by any airline, authority or country, including countries through which you may travel en route to your destination.

14.3. You must also consult your doctor about current vaccination recommendations before travelling abroad and ensure that you meet all medical requirements for entry and follow all medical instructions relating to your trip.

14.4. Although most travel, including travel to international destinations, is without incident, travel to certain destinations may be more risky than others. BOOKINGMAP encourages travelers to research and review travel bans, warnings, announcements and advisories issued by their own and destination governments before booking travel to international destinations.

14.5. By placing information about travel to certain destinations, we do not guarantee that the journey in question is recommended or without risk and accept no liability for damage or loss arising from travel to that destination.

15. Limitation of liability

15.1 The information, software, products and services published or otherwise presented on the Platform may contain inaccuracies and errors, including those relating to the availability for booking and prices. BOOKINGMAP does not guarantee the accuracy of the information and undertakes no liability for errors or other inaccuracies in the information on holiday accommodations and their descriptions, air and sea routes, restaurants and any other tourist services described on the Platform (including but not limited to prices, accessibility information, photographs, listings of holiday accommodation, entertainment, air and sea routes, restaurants and other tourist products, general product features, reviews, ratings, etc.). Moreover, BOOKINGMAP unconditionally reserves the right to correct any errors in the prices on our Platform and/or pending bookings made at incorrect prices.

15.2. BOOKINGMAP makes no warranty of any kind as to the suitability of the services, including information on its website, in whole or in part, for any purpose, and the inclusion of products or services (or their offer) on the website or otherwise through the Platform does not constitute an approval or recommendation by BOOKINGMAP of such product or service, except for awards granted on the basis of ratings and user feedback.

15.3. All such information, software, products and services are provided by or through the Platform "as is", without warranty of any kind. 

15.4. BOOKINGMAP disclaims all warranties, terms and conditions and other obligations regarding the absence of viruses and other harmful components on our servers or in other data (including email) sent by BOOKINGMAP. 

15.5. BOOKINGMAP also disclaims any warranty, representation or other obligation as to the accuracy or propriety of the materials available on the Platform.

15.6. To the extent permitted under mandatory consumer protection law, we will only be liable for costs incurred by you as a direct result of a failure on our part. This means that, to the extent permitted by law, we are not liable (for example) for:

consequential losses or indirect damages;

inaccurate information about the Service Provider;

products, services or activities of the Service Provider or other business partner;

errors in e-mail addresses, telephone numbers or credit card numbers (unless the errors are attributable to us);

force majeure or events beyond our control.

15.7. If you fail to comply with this T&C and/or the terms and conditions of the Service Provider, to the extent permitted by law:

we will not be liable for any costs you incur as a result; and

you will not be entitled to a refund.

15.8. To the extent permitted by law, the limit of our liability or that of any Service Provider (whether a single event or a series of related events) is the value of your Booking as set out in your confirmation email.

15.9. We make no guarantees about the products and services of Service Providers (except as expressly stated in this T&C). You are solely responsible for making the right choice.

15.10. This T&C and the above disclaimer do not affect any mandatory legal rights which are inherent under applicable law, such as rights arising under consumer protection law in the relevant country.

15.11. If the law of your country of residence does not permit the private limitation or exclusion of liability set out in this clause, such limitation or exclusion shall not apply. The disclaimer of liability will otherwise apply to the maximum extent permitted by applicable law.

16. Applicable law and jurisdiction

16.1. To the extent permitted by mandatory local law (consumer protection), this T&C and the operation of our Platform will be governed by the law of the United Kingdom.

16.2. To the extent permitted under mandatory local law (consumer protection), any dispute will be referred exclusively before the competent courts in the United Kingdom.

17. Linked travel arrangements

If:

after selecting and paying for one travel service, you book additional travel services for your trip or holiday during the same visit to the Platform; or

you book additional travel services for your trip or holiday via a link provided to you by us not later than 24 hours after receiving confirmation of your initial Booking with us,

you will NOT benefit from rights applying to packages under the EU’s Directive (EU) 2015/2302 or the UK's Package Travel and Linked Travel Arrangements Regulations 2018 (together, the ‘Package Travel Requirements’). Therefore, we will not be responsible for the proper performance of those travel services. In case of problems, please contact the relevant Service Provider.
